Gang Stalking Laws and the Steps You Need to Take to Prove Your Case in Court

Is gang stalking prohibited by law? Yes, it may not be described as “gang stalking” per se, but the methods and tactics perpetrators use against their victims or targets are not permitted by law.

Find various laws that gang stalkers violate. This information is not offered as legal or prescriptive advice and you should check the specificity of local laws. Your state statutes should provide provisions similar to those provided in this document.

1. Federal RICO Law – 18 USC Chapter 96 if it involves extortion; there must be some kind of company, system, or group of people who carry out illegal activities for profit.

2. Laws Against Stalking – Wisconsin Statute 940.32; you would have to go after each individual stalker, which, as we know, is hard to do if the people you stalk rotate and change, and if you can be bothered to make the police take you seriously.

3. Harassment Laws – Wisconsin Statute 947.013; you would have to prove a “course of conduct” which means a pattern, or repeated acts that harass or intimidate a person and, a more serious subsection that can cause more legal problems for the perpetrator(s) is if you can show a “credible threat “, which means that a real threat would have to be made against you. But you can’t file a private cause of action, in short, you can’t get damages (receive money) for the harassment.

4. Transfer to land – Wisconsin Statute 943.13. Even if you are a tenant of a property and did not give permission for someone to be on your property, you still qualify. This statute can help if you can actually show trespassing, such as the stalkers actually entering private property or placing spy or surveillance equipment on the property.

5. Illegal entry to the person/

Assault, Battery, Fake Prison.

Assault – Wisconsin Statute 940.19, must prove bodily harm without your consent.

False Imprisonment – Wisconsin Statute 940.30, you must prove that someone you knew you did not have legal authority intentionally confined or restrained you without your consent.

6. Invasion of Privacy – Wisconsin Statute 942.08; he would have to prove that a person entered a place where he would expect privacy, or entered private property, and observed him or installed some surveillance device on said property.

7. Defamation – Wisconsin Statute 942.01; would have to prove that someone communicated something to a third party that was defamatory in nature, was untrue, without good reason, without justification, and was not privileged (meaning that you did not consent to the communication and the person communicates the defamation had no absolute privilege to do so.)

If the person can show that they have a conditional privilege to communicate the defamatory material, it may not be considered defamatory.

Slander, spoken defamation, requires the testimony of 2 other people who heard and understood the oral statement as defamatory. Libel is a written slander or published false statement.

People then wonder what they have to do to prove they are being gang harassed in court. The police and “court system” may not be on your side and you may very well have to do your own work on your case. He is looking to prove violations of the laws as stated above. Therefore, point your evidence in the direction of proving those violations.

A. Have people witness what you are experiencing so they can testify on your behalf in court.

B. Take a video camera with you wherever you go. Video record the perpetrators and their actions against you. Keep getting more images. It’s best if you can show the SAME people who harass you or your family.

C. Keep detailed written records and notes of gang stalking activity.

D. Take photos of what is happening and what is going on with the harassing behavior.

E. Show your evidence to other people; friends, family, private detectives, lawyers.

F. Install hidden security cameras around your residence, your vehicle, your office.

G. Reach out to other survivors of gang, group, or organized stalking. There are online groups and anonymous blogs that can offer you support.
